Flooring Leads Flow Cost-Per-Lead (CPL) Program Terms & Conditions

These Cost-Per-Lead ("CPL") Program Terms & Conditions ("Terms") govern participation in the Flooring Leads Flow lead generation program.

By enrolling in a Flooring Leads Flow campaign, purchasing leads, providing payment information, electronically accepting these Terms, or otherwise using the Flooring Leads Flow services, the participating contractor or business ("Contractor," "you," or "your") agrees to these Terms.

If you do not agree to these Terms, you should not purchase or accept leads through Flooring Leads Flow.

1. Flooring Leads Flow Services

Flooring Leads Flow provides lead generation and lead delivery services designed to connect flooring contractors with prospective customers who have expressed interest in flooring-related services.

Flooring Leads Flow may generate leads through various marketing channels, including digital advertising, websites, landing pages, search marketing, social media, referral sources, partnerships, organic traffic, and other marketing methods.

Flooring Leads Flow provides prospective customer opportunities. Flooring Leads Flow does not perform flooring services and is not a party to any agreement subsequently entered into between a Contractor and a prospective customer.

2. Cost-Per-Lead Pricing

Flooring Leads Flow operates primarily on a Cost-Per-Lead ("CPL") pricing model.

Under the CPL model, Contractors are charged an agreed price for each qualified lead delivered according to the applicable campaign criteria.

CPL rates may vary based on factors including:

  • Geographic market
  • City, county, ZIP code, or service area
  • Flooring service requested
  • Residential or commercial project type
  • Lead qualification criteria
  • Lead exclusivity
  • Market competition
  • Requested lead volume
  • Campaign structure
  • Other market or campaign-specific factors

The applicable CPL rate will be communicated to the Contractor before the applicable campaign begins or otherwise established in the Contractor's campaign or purchase agreement.

Flooring Leads Flow does not guarantee that all Contractors, territories, or flooring services will receive the same CPL pricing.

3. Qualified Leads

A qualified lead generally means a prospective customer who has expressed an interest in an eligible flooring service and meets the applicable campaign criteria.

Depending on the campaign, a qualified lead may contain:

  • Customer name
  • Phone number
  • Email address
  • Project location
  • Requested flooring service
  • Residential or commercial designation
  • Project description
  • Project timeframe
  • Other project information when available

Specific qualification requirements may vary by campaign.

A qualified lead represents an opportunity to pursue potential business. It does not represent or guarantee an appointment, estimate, sale, revenue amount, profit, or completed flooring project.

4. Billable Leads

Unless otherwise agreed in writing, a Contractor will be charged the applicable CPL for each qualified lead delivered under the Contractor's active campaign.

A lead may remain billable even when:

  • The prospective customer does not answer the Contractor's call.
  • The prospective customer does not return a voicemail, email, or text message.
  • The Contractor is unable to contact the prospect.
  • The prospect changes their mind.
  • The prospect postpones or cancels the project.
  • The prospect receives multiple estimates.
  • The prospect hires another flooring contractor.
  • The Contractor's estimate is rejected.
  • The Contractor decides not to pursue the project.
  • The Contractor is unavailable to perform the work.
  • The Contractor does not contact the prospect promptly.
  • The Contractor does not ultimately close the sale.

Contractors purchase qualified opportunities, not guaranteed sales.

5. Lead Credit Policy

Leads that appear to contain invalid information or fail to meet applicable campaign requirements may be eligible for review under the Flooring Leads Flow Lead Credit & Refund Policy.

Potentially creditable circumstances may include:

  • Invalid or disconnected contact information
  • Clearly fake or fraudulent information
  • Spam or solicitation
  • Customer denial of making the flooring inquiry
  • Project outside the agreed territory
  • Service outside the Contractor's selected campaign categories
  • Qualifying duplicate leads
  • Failure to meet another specifically agreed qualification requirement

Lead credit requests must generally be submitted within 5 calendar days of lead delivery.

All credit requests are subject to review and approval under the Flooring Leads Flow Lead Credit & Refund Policy.

Approved lead credits will generally be applied to the Contractor's account toward future leads rather than issued as cash refunds, unless otherwise required by applicable law or expressly agreed to in writing.

The Flooring Leads Flow Lead Credit & Refund Policy is incorporated into these Terms by reference.

6. Duplicate Leads

Unless otherwise specified in the applicable campaign agreement, Flooring Leads Flow generally considers a lead a duplicate when the same identifiable prospect requesting substantially the same flooring project is delivered to the same Contractor within 30 calendar days of the original lead.

A new inquiry from the same person may be considered a separate billable lead when:

  • More than 30 calendar days have passed;
  • The inquiry involves a materially different flooring project;
  • The inquiry involves a different property;
  • The customer requests a materially different service; or
  • Other circumstances reasonably indicate that the inquiry represents a new business opportunity.

Duplicate determinations are made according to the Lead Credit & Refund Policy and available lead information.

7. Standard and Exclusive Leads

Flooring Leads Flow may offer both standard/shared and exclusive lead programs.

Standard Leads

Standard leads may be delivered or otherwise made available according to the sharing terms established for the applicable campaign.

Participation in a standard lead program does not guarantee that the prospective customer has not contacted, or will not independently contact, another flooring company.

Exclusive Leads

When a lead is specifically sold and designated by Flooring Leads Flow as an "Exclusive Lead," Flooring Leads Flow intends to deliver that lead to only one participating Flooring Leads Flow Contractor under the applicable campaign.

Exclusive status does not prevent the prospective customer from independently contacting other contractors, requesting additional estimates, using other websites, or hiring another company.

A lead should not be considered exclusive unless Flooring Leads Flow specifically identifies the applicable campaign or lead as exclusive.

8. Territory Selection

Contractors may select geographic areas in which they wish to receive leads, subject to availability and campaign approval.

Territories may be established using:

  • ZIP codes
  • Cities
  • Counties
  • Service radius
  • Geographic regions
  • Other agreed geographic criteria

Territory availability is not guaranteed.

Unless expressly stated in writing, selecting a territory does not grant the Contractor exclusive ownership of that geographic market.

Flooring Leads Flow may work with other flooring businesses within the same geographic area depending on campaign structure, lead type, capacity, and availability.

9. Flooring Service Selection

Contractors may select specific flooring services for which they wish to receive leads.

These may include:

  • Hardwood flooring installation
  • Hardwood floor refinishing
  • Luxury vinyl plank (LVP)
  • Laminate flooring
  • Tile flooring
  • Flooring repair
  • Floor replacement
  • Residential flooring
  • Commercial flooring
  • Other approved flooring services

Contractors are responsible for ensuring that they are legally and professionally qualified to perform the services selected.

10. Lead Volume and Lead Caps

Contractors may establish a desired or maximum lead volume subject to campaign availability.

Examples may include:

  • Monthly lead target
  • Monthly lead cap
  • Weekly lead cap
  • Campaign budget limit
  • Other agreed delivery limitations

A requested lead volume is not a guarantee that Flooring Leads Flow will deliver that number of leads.

Lead availability depends on customer demand, geography, service type, seasonality, advertising performance, competition, and other market conditions.

Flooring Leads Flow will make reasonable efforts to honor agreed lead caps.

11. Billing Authorization

By participating in a paid Flooring Leads Flow campaign and providing a payment method, the Contractor authorizes Flooring Leads Flow and its payment processor to charge the payment method according to the applicable CPL rate and billing arrangement.

Depending on the campaign, billing may occur:

  • Per individual lead;
  • After a predetermined number of leads;
  • At scheduled billing intervals;
  • Against a prepaid lead balance;
  • Upon reaching an agreed billing threshold; or
  • According to another billing arrangement disclosed to the Contractor.

The Contractor is responsible for maintaining a valid payment method.

12. Prepaid Lead Balances

Flooring Leads Flow may offer campaigns requiring Contractors to fund an account or purchase a lead balance in advance.

When applicable, qualifying lead charges will be deducted from the Contractor's available balance as leads are delivered.

Approved lead credits may be returned to the Contractor's available Flooring Leads Flow account balance.

Unless otherwise stated in writing or required by law, prepaid balances are intended for purchasing Flooring Leads Flow services and are subject to the applicable campaign, cancellation, and refund terms.

13. Failed Payments

If a Contractor's payment method is declined, expired, disputed, reversed, or otherwise unavailable, Flooring Leads Flow may:

  • Temporarily pause lead delivery;
  • Request an updated payment method;
  • Attempt to collect an outstanding authorized balance;
  • Suspend the Contractor's account; or
  • Terminate the campaign.

The Contractor remains responsible for legitimate charges incurred before suspension or termination.

14. Billing Questions and Disputes

Contractors should promptly review invoices, lead charges, and account activity.

Questions regarding a specific lead should be submitted through the Lead Credit process within the applicable 5-calendar-day lead review period.

Questions regarding other billing errors should be reported to Flooring Leads Flow as soon as reasonably possible.

Initiating a payment dispute or chargeback does not automatically eliminate a valid payment obligation.

Nothing in these Terms limits rights that cannot legally be waived under applicable law.

15. Campaign Pauses

Contractors may request that future lead delivery be paused.

A pause becomes effective when processed and confirmed by Flooring Leads Flow, subject to any campaign-specific terms communicated to the Contractor.

Leads generated, matched, or delivered before a pause becomes effective may remain billable.

Contractors should not assume a campaign has been paused until the pause has been confirmed.

16. Campaign Cancellation

Unless a separate campaign agreement states otherwise, Contractors may request cancellation of future lead delivery.

Cancellation does not eliminate payment obligations for qualified leads delivered before the cancellation becomes effective.

Flooring Leads Flow may require reasonable time to process a cancellation request and stop active campaign activity.

Any campaign-specific minimum purchase, prepaid balance, promotional offer, or other commitment will be governed by the terms disclosed when the Contractor enrolls.

17. CPL Rate Changes

Flooring Leads Flow may periodically adjust CPL pricing due to changes in:

  • Advertising costs
  • Market competition
  • Geography
  • Lead quality requirements
  • Flooring service category
  • Lead exclusivity
  • Market demand
  • Campaign performance
  • Other material factors

Flooring Leads Flow will communicate material CPL changes before the new rate applies to future leads under an existing campaign, unless another pricing mechanism has already been agreed upon.

Continued participation after the effective date of a communicated rate change constitutes acceptance of the new rate, subject to applicable law.

18. Contractor Follow-Up

Lead value can decline quickly when prospective customers are not contacted promptly.

Contractors are strongly encouraged to contact new leads as soon as reasonably possible after delivery and to make reasonable follow-up attempts.

Flooring Leads Flow is not responsible for lost opportunities resulting from delayed, inadequate, or unsuccessful Contractor follow-up.

19. Contractor Responsibilities

Each Contractor is solely responsible for operating its flooring business and for all interactions with prospective customers.

Contractors are responsible for:

  • Maintaining applicable licenses and registrations
  • Maintaining appropriate insurance
  • Following applicable laws and regulations
  • Providing accurate business information
  • Communicating professionally with prospective customers
  • Providing estimates and proposals
  • Establishing pricing
  • Scheduling projects
  • Performing contracted services
  • Collecting customer payments
  • Handling warranties and customer disputes
  • Managing their employees and subcontractors
  • Protecting customer information

Flooring Leads Flow does not supervise, direct, endorse, warrant, or guarantee a Contractor's flooring services.

20. Customer Information and Permitted Use

Lead information provided by Flooring Leads Flow may be used by the receiving Contractor for the legitimate purpose of responding to the prospective customer's flooring inquiry and related follow-up, subject to applicable law and the consent associated with the lead.

Contractors may not:

  • Sell lead information to unauthorized third parties;
  • Publish customer information;
  • Use lead information for unrelated marketing without appropriate authorization;
  • Use customer information unlawfully;
  • Engage in harassment, deceptive communications, or unlawful solicitation.

Contractors are responsible for their own compliance with applicable privacy, telemarketing, texting, email marketing, and consumer-protection laws.

21. No Guarantee of Results

Flooring Leads Flow does not guarantee:

  • Contact rates
  • Appointment rates
  • Estimate rates
  • Closing rates
  • Number of completed jobs
  • Project values
  • Revenue
  • Profit
  • Return on investment
  • Return on advertising spend
  • Customer purchasing decisions

Results depend on numerous factors outside Flooring Leads Flow's control, including:

  • Contractor follow-up
  • Sales ability
  • Pricing
  • Reputation and reviews
  • Customer experience
  • Market conditions
  • Competition
  • Seasonality
  • Project availability
  • Customer preferences

Any calculators, examples, case studies, revenue illustrations, projections, or performance estimates are provided for informational purposes and do not constitute guarantees.

22. No Contractor-Customer Relationship With Flooring Leads Flow

Flooring Leads Flow acts as a lead generation and lead delivery provider.

Flooring Leads Flow is not the flooring contractor performing the requested service and does not become a party to any agreement between a Contractor and a prospective customer.

Any contract for flooring services is solely between the Contractor and the customer.

Flooring Leads Flow is not responsible for workmanship, pricing, project completion, property damage, warranties, injuries, payment disputes, or other matters arising from the Contractor-customer relationship, except to the extent responsibility cannot legally be excluded.

23. Limitation of Liability

To the fullest extent permitted by applicable law, Flooring Leads Flow will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages arising from participation in the CPL program, including lost profits, lost business opportunities, or lost revenue.

To the fullest extent permitted by law, Flooring Leads Flow's aggregate liability arising from a particular disputed lead will not exceed the amount actually paid to Flooring Leads Flow for that lead.

Any broader limitation applicable to the Contractor's account or campaign may be established in a separate written agreement.

Nothing in these Terms excludes liability that cannot legally be excluded or limited.

24. Indemnification

To the extent permitted by law, the Contractor agrees to indemnify, defend, and hold harmless Flooring Leads Flow and its owners, officers, employees, agents, and service providers from third-party claims, damages, liabilities, costs, or expenses arising from the Contractor's:

  • Flooring services;
  • Communications with prospective customers;
  • Violation of applicable law;
  • Misuse of lead information;
  • Breach of these Terms; or
  • Acts or omissions in connection with a customer project.

25. Suspension or Termination by Flooring Leads Flow

Flooring Leads Flow may suspend or terminate a Contractor's participation for reasons including:

  • Unpaid balances
  • Payment fraud
  • Abusive credit requests
  • Misuse of customer information
  • Customer complaints involving inappropriate conduct
  • Violation of these Terms
  • Unlawful activity
  • Fraudulent activity
  • Material misrepresentation
  • Conduct that creates material risk to customers or Flooring Leads Flow

Termination does not eliminate legitimate payment obligations incurred before termination.

26. Independent Businesses

Nothing in these Terms creates an employment relationship, partnership, joint venture, franchise, fiduciary relationship, or agency relationship between Flooring Leads Flow and the Contractor.

The Contractor operates as an independent business.

27. Electronic Communications

By enrolling in the CPL program, the Contractor agrees that Flooring Leads Flow may communicate regarding the Contractor's account, leads, billing, campaign activity, support requests, and service-related matters electronically.

This may include email, telephone, text message, dashboard notifications, or other contact methods provided by the Contractor, subject to applicable law.

28. Changes to These Terms

Flooring Leads Flow may update these Terms periodically.

Material changes affecting an active Contractor's CPL pricing, billing obligations, or other significant campaign terms will be communicated as appropriate before applying to future services, subject to applicable law.

The Effective Date displayed above identifies the current version of these Terms.

29. Entire Agreement

These Terms, together with the applicable campaign agreement, CPL pricing, Lead Credit & Refund Policy, Privacy Policy, and any other terms expressly incorporated by reference, constitute the agreement governing the Contractor's participation in the Flooring Leads Flow CPL program.

If a separately executed campaign agreement conflicts with these general Terms, the more specific campaign agreement will control with respect to that conflict unless otherwise stated.

30. Severability

If any provision of these Terms is determined to be invalid or unenforceable, the remaining provisions will continue in effect to the fullest extent permitted by law.

31. Waiver

Failure by Flooring Leads Flow to enforce a provision of these Terms on one occasion does not waive its right to enforce that provision or another provision in the future.

32. Contact and Questions

Questions regarding these Terms, CPL pricing, billing, campaign settings, or lead credits should be directed to Flooring Leads Flow using the contact information provided on the Flooring Leads Flow website.

Lead-specific disputes should be submitted within the applicable 5-calendar-day Lead Credit review period.

Contractor Acknowledgment

By purchasing leads, activating a campaign, electronically accepting these Terms, or otherwise participating in the Flooring Leads Flow CPL Program, the Contractor acknowledges that:

  1. Flooring Leads Flow charges for qualified leads, not closed flooring jobs.
  2. A lead does not guarantee contact, an appointment, estimate, sale, revenue, profit, or completed project.
  3. The Contractor is responsible for promptly contacting and following up with leads.
  4. Lead credit requests must generally be submitted within 5 calendar days of delivery.
  5. Standard leads are not assumed to be exclusive unless expressly designated otherwise.
  6. The Contractor authorizes charges according to the CPL pricing and billing arrangement accepted for its campaign.
  7. The Contractor has reviewed and agrees to the Flooring Leads Flow Lead Credit & Refund Policy.
